Before developing a remote monitoring program, a land trust needs to weigh not only the benefits but also the drawbacks of this type of stewardship. In fact, overreliance on remote monitoring could jeopardize successful dispute resolution or legal defense against landowner violations or third-party encroachments and could result in failure to identify violations and encroachments in a timely manner. Inadequate data retention and storage can render remote imagery inadmissible or not credible in court. Therefore, it is essential to conduct a thoughtful property-specific analysis to determine whether remote monitoring is appropriate for a property or a portion thereof.
