Land trusts threatened with or considering pursuing litigation should understand the protections afforded by the work product doctrine to accommodate transparent and frank communications with attorneys. The work product doctrine is an evidentiary rule that protects written or oral materials from disclosure to an adverse party if they are prepared by or for an attorney, in anticipation of litigation.
