About This Practical Pointer
Land trusts threatened with or considering pursuing litigation should understand the protections afforded by the work product doctrine to accommodate transparent and frank communications with attorneys. The work product doctrine is an evidentiary rule that protects written or oral materials from disclosure to an adverse party if they are prepared by or for an attorney, in anticipation of litigation. It allows attorneys to develop their legal theories in connection with litigation without fear that the opposing party might discover them. This document details the elements of the work product doctrine and offers practical suggestions on how to work with the work product doctrine while preparing for litigation.
