Clover/Allen’s Creek Neighborhood Ass’n LLC v. M&F, LLC
The trial court dismissed all claims. As for the quiet title action, the Association was held to lack standing because it did not hold any interest in the trail easement. The court also dismissed the public trust doctrine claim because the Town only held a non-exclusive trail easement, rather than a fee simple.
Van Dyke v. Dunker & Aced
The trial court dismissed the action because it was outside of the two-year statute of limitations period. The appellate court affirmed, applying the 'discovery rule' that a malpractice cause of action accrues when the client discovers, or should discover, the facts essential to the claim.
Rodgers v. Vilsack
The trial court dismissed the suit in favor of the United States, finding that Rodgers' violations of the easement were so clear that there was no true title dispute, and therefore no jurisdiction under the Quiet Title Act.
United States v. Peterson

Government filed a criminal misdemeanor suit and the trial court, acting on the findings of a magistrate judge after a bench trial, held for the Government in all respects. The Eighth Circuit affirmed .
Kutz v. Lee
The trial court dismissed all landowner claims regarding public access for lack of standing, lack of timely notice under the Oregon Tort Claims Act, and for exceeding the statute of limitations. The landowners appealed. The intermediate appellate court reversed.
Telzrow v. United States
The Court of Federal Claims denied NRCS's motion to dismiss, holding that Telzrow could bring a breach of contract action. At the same time, the court dismissed the attempt to nullify the easement.
Egan et al. v. Planning Board of the City of Stamford et al.
The trial court held that the conservation easement was indeed an obstruction that rendered the accessway unusable.
United States v. Seest
The Eighth Circuit upheld the criminal conviction, noting a clear violation of the easement.
