The California intermediate appellate court upheld a trial court’s denial of coverage to Thompson on the same issues as in Henstooth Ranch LLC v. Burlington Insurance, 293 F.Supp.3d 1067 (N. D. Ca. Jan. 3, 2018), aff’d 770 Fed. Appx. 804 Cir. May 22, 2019). The appellate court held that the doctrine of issue preclusion (also known as collateral estoppel) applied, meaning that the earlier federal court rulings in Henstooth Ranch that Thompson’s actions were not accidental precluded him from re-raising that identical issue here.
