About This Legal Opinion

In this landowner challenge to a conservation easement’s division restriction, the District Court granted summary judgment in favor of the federal holder, finding that the sale of one of the three parcels was a violation of the division restriction.

November 2025 Update: In a brief opinion, the Second Circuit affirmed the District Court, finding that the plain language of the easement prohibited any division, even if the protected property was comprised of multiple distinct parcels.
