The court ruled that the open space deed restriction held by CCC could be an exaction, even if no conveyance to another entity occurs, and therefore the Nollan and Dolan jurisprudence applies. Similar to its April 2010 decision, the court then ruled that the deed restriction failed the Nollan and Dolan tests.
