In this land swap case involving conservation land, the court found the proposed swap was in compliance with the state land exchange statute and no violation of the deed restriction would follow from the swap.
November 2025 Update: The appellate court noted that sovereign immunity was a threshold jurisdictional issue, and should have been the sole basis for the trial court’s adjudication of the matter. Finding that the suit was in fact barred by sovereign immunity, the appellate court vacated the trial court's summary judgment order and remanded the case for entry of a dismissal order.
