Narowski leased a sugarbush, with restrictions on sugaring activities, from a landowner who later died and left her land to the State of Vermont. The State claimed it terminated the lease based upon breaches of the lease. Narowski filed a motion for preliminary injunction against interference with the forthcoming sugaring season. The Court issued the injunction pending a final decision on the merits finding that Narowski would likely prevail on the merits, that public policy required enforcing leases, that the citizens of Vermont would be harmed if the injunction did not issue, and that Narowski would suffer irreparable harm.
