Owner of one geographic portion of conservation easement property had standing to challenge partial termination of easement affecting another geographic portion.

July 2023 Update: In an update to this ongoing matter to invalidate an amendment to a conservation easement, the court dismissed several counterclaims including the validity of a conservation easement, slander of title and intentional interference with prospective contractual relations.

November 2025 Update: The parties settled the suit in September 2025 with the court’s approval of a consent order. The settlement entailed unspecified payments by the hospital to MST and NALT and by the Youngs to the hospital. The parties also acknowledged that the amendment was valid and that the conservation easement no longer restricted the 57 acres, although MST and the hospital did agree to an unspecified restrictive covenant on this parcel.
