About This Guidance

On November 10, 2022, the Michigan Appellate Court handed down a huge victory for conservation in deciding to keep a protected farm unified pursuant to a no division clause in the underlying conservation easement. The win sends a resounding national message that conservation advocates keep their promises to steward the land in perpetuity. The win also shows the power of conservation partnerships, here, the Alliance joined with three partners to submit an amicus brief that helped ensure the win. Important takeaways for land trusts are set forth in the attached resource.
