The appellate court held that the 1893 deed did establish a charitable trust, even though that transaction was a sale and not a donation. The court further held that the parcel remained suitable for park purposes and therefore declined to apply the cy pres doctrine.

In this case, a land trust claimed title to a piece of property by virtue of a quitclaim deed or, in the alternative, by adverse possession. The court found that the land trust did not have title by virtue of a deed but reserved judgment on the adverse possession claim.
