In this Pennsylvania Supreme Court decision, the court finds that both the Open Space Lands Act and the terms of the open space easement require the County easement holder to approve any right-of-way. The Pennsylvania high court’s opinion reverses a confused and confusing Commonwealth court opinion, and represents a victory for Pennsylvania conservation easement holders.
