This paper examines the sections of California law known collectively as the Solar Rights Act (or “the Act”), and reviews lawsuits brought under the Act. Through the Act, which was enacted in 1978 and later amended, the legislature sought to balance the needs of individual solar energy system owners with other property owners by developing solar access rights. The Act limits the ability of covenants, conditions, and restrictions, typically enforced by homeowner associations (HOA), and local
governments to restrict solar installations. The language however is extremely broad and has been interpreted to also encompass private land trusts and conservation easement restrictions on structures and uses.
